Terms of Service

1. Agreement to Terms

By accessing or using DopeDuka's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

DopeDuka provides ecommerce services including but not limited to: website development, app and software development, UI/UX design, ecommerce consultations, store management, automation, and monthly hosting plans. The scope, deliverables, and pricing for each project are agreed upon before work begins.

3. Pricing & Payments

  • All prices are listed in Kenyan Shillings (KES) and are subject to change with prior notice.
  • Monthly hosting plans are billed at the start of each billing cycle. Late payments may result in service suspension.
  • One-time development services require a deposit before work begins, with the balance due upon completion.
  • Refunds are handled on a case-by-case basis. We do not offer refunds for completed and delivered work.

4. Client Responsibilities

  • Provide accurate and complete information required for your project.
  • Review and provide feedback on deliverables within agreed timelines.
  • Ensure you have the rights to all content (images, text, logos) you provide to us.
  • Maintain the confidentiality of any account credentials we provide.

5. Intellectual Property

Upon full payment, you own the final deliverables (website, designs, code) created specifically for your project. DopeDuka retains the right to use general techniques, tools, and frameworks developed during the project. We may feature your project in our portfolio unless you request otherwise.

6. Hosting & Uptime

For clients on monthly hosting plans, we strive for 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control (e.g., third-party services, internet outages).

7. Limitation of Liability

DopeDuka shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Termination

Either party may terminate the service agreement with 30 days' written notice. Upon termination of a hosting plan, we will provide you with a copy of your data and website files. Unpaid balances remain due after termination.

9. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page and take effect immediately. Continued use of our services constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of Kenya. Any disputes shall be resolved through negotiation, and if unresolved, through arbitration in Nairobi.
